Every business and workplace within New Zealand should be safe and the HSWA 2015 is the key legislation enacted to provide employees with protection. There are obligations and duties for the PCBU (Person Controlling a Business or Undertaking) who maybe a CEO, Director, Owner, Sole Trader or Contractor.
Employees have rights, duties and obligations and in collaboration and cooperation ,management and staff should work together.
Consultation is key as is evidence and proof. If there is a Hazard it must be identified and the Risk of Harm assessed before any Control of Risk measures are introduced. When PCBUs are confused they may go straight to assigning controls before assessing risk.
